Official Rules for Gift Card Sweepstakes
ACCION OPPORTUNITY FUND SMALL BUSINESS OWNER SURVEY
VOID WHERE PROHIBITED. NO PURCHASE, PAYMENT OR CONTRIBUTION NECESSARY TO ENTER OR WIN.
A PURCHASE, CONTRIBUTION, OR PAYMENT WILL NOT IMPROVE YOUR CHANCES OF WINNING. BY ENTERING THE SWEEPSTAKES, ENTRANT AGREES TO BE BOUND BY THESE OFFICIAL RULES.
Accion Opportunity Fund Community Development (the “Sponsor”) is conducting this gift card sweepstakes (“Sweepstakes”) for eligible individuals who complete a survey (the “Survey”). These Official Rules (“Rules”) govern this Sweepstakes. Details and qualifications for participation in this promotion may apply. This Sweepstakes is void where prohibited by law.
ENTRY PERIOD: The Entry Period of the Sweepstakes begins at 7:00am Pacific Time (PT) on March 24, 2023 and ends at 11:59pm PT on May 10th, 2023.
ELIGIBILITY: The Sweepstakes is open to individuals who: (a) are 18 years of age or older at time of Entry, and (b) have received from Sponsor an email message with a website link requesting that they complete the Survey OR who have visited the link to the Survey listed on the Sponsor’s website. Employees, officers and directors of the Sponsor, its parents, subsidiaries, affiliates, representatives and agencies, and members of their immediate families (spouses, parents, siblings and children, regardless of where they live) and those living in the same household are not eligible to enter or win the Sweepstakes.
HOW TO ENTER: Participants may enter either by the Survey Method or by the No-Survey Entry Method, as described herein:
(a) Survey Method: Eligible participants can enter the Sweepstakes by visiting the link on aofund.org or the website link provided in the Survey invitation sent via email and completing the Survey during the Entry Period. Entrants must complete all required information, including your first name, last name, and email address. An entry is “received” when an eligible participant completes the Survey and the servers for the Survey administrator record the information (each, an “Entry”). Only one Entry is permitted for each Survey invitation sent via email. There is no cost to enter the Sweepstakes. Entries must be made by May 10th, 2023, at 11:59 p.m. PT to qualify for entry. You may enter only once. The length of time required to complete a survey will vary from approximately 10 to 20 minutes.
(b) No-Survey Entry Method: To enter via the No-Survey Method, you are not required to complete a survey to enter. Eligible entrants must submit an entry by visiting the link on aofund.org or the website link provided in the Survey invitation sent via email and providing your first name, last name, and email address. An entry is “received” when an eligible participant provides this information and the servers for the Sweepstakes administrator record the information (each, an “Entry”). Only one Entry is permitted for each Survey invitation sent via email. There is no cost to enter the Sweepstakes. Entries must be made online by May 10, 2023, at 11:59 p.m. PST to qualify for entry. You may enter only once.
The winner must meet the eligibility requirements set forth in these Rules in order to qualify for the prize. In the event of a dispute over the identity of a Sweepstakes entrant, each Entry will be deemed submitted by the registered account holder of the email address associated with the Entry. If the Sponsor is not able to verify to its satisfaction the identity of the individual who actually submitted the Entry selected as the Sweepstakes winner, the affected Entry will be deemed ineligible and the Sponsor will draw another Entry as Sweepstakes winner.
PRIZE: One Amazon gift card with a value of $100, fulfilled electronically. The Approximate Retail Value (“ARV”) of each Prize is $100. Any difference between the actual retail value of a prize and the ARV will not be awarded. The actual retail value may vary depending on variables. No substitution, assignment or transfer of any prizes are permitted, except by Sponsor, who reserves the right to substitute the prizes with another of comparable or greater value.
ODDS OF WINNING: Odds of winning depend upon the number of eligible Entries received within the Entry Period for this Sweepstakes.
PRIZE DRAWING: A random drawing will be conducted from among all eligible Entries received during the Entry Period for the Sweepstakes. The prize drawing will be conducted by the Survey administrator within 15 calendar days after the Entry Period ends. Each entry will be assigned a random number. At the end of the entry period a random number generator will be used to select the winner. The process will be recorded.
WINNER(S) NOTIFICATION: The winner(s) will be notified via telephone and/or e-mail and is subject to verification of eligibility.
PRIZE RESTRICTIONS: The prize is not transferable. If the winner fails to claim the prize within five days of notification, fails to abide by these Rules, or is otherwise ineligible, Sponsor may select an alternate winner from all remaining eligible Entries. Sponsor reserves the right to substitute a prize of equal or greater value without notice. All decisions on matters pertaining to the Sweepstakes are final. All federal, state and local taxes, fees and surcharges on prizes are the sole responsibility of the prize winner. Sponsor will not replace any gift card prize that is lost or stolen once delivered to the winner.
WAIVER OF LIABILITY/PUBLICITY RELEASE: By participating in the Sweepstakes and submitting an Entry, each participant agrees to (i) be bound by these Rules, including all entry requirements, and (ii) waive any and all claims against the Sponsor and Survey administrator and their respective parents, affiliated companies, subsidiaries, officers, directors, employees, agents, licensees, representatives and advertising and promotion agencies, and any and all other companies associated with the Sweepstakes, and all of their respective officers, directors, employees, agents and representatives (collectively, the “Released Parties”) for any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from the participation in the Sweepstakes or from the receipt or use of any prize (or any portion thereof) or any travel or activity related to the receipt or use of any prize (or any portion thereof).
By entering this Sweepstakes, each participant gives his/her express permission to be contacted by the Sponsor by telephone, e-mail and/or postal mail for Sweepstakes purposes.
The winner, by acceptance of Prize, grants to Sponsor, and each of its respective designees, the right to publicize the winner’s name, address (city and state of residence), photograph, voice, statements and/or other likeness and prize information for advertising, promotional, trade and/or any other purpose in any media or format now known or hereafter devised, throughout the world, in perpetuity, without limitation and without further compensation, consideration, permission or notification, unless prohibited by law.
PRIVACY POLICY: Information collected in connection with this Sweepstakes will be used in accordance with Sponsor’s Privacy Policy and these Rules. In the event of any discrepancy between Sponsor’s Privacy Policy and these Rules, Sponsor’s Privacy Policy shall control and govern. Sponsor’s Privacy Policy is available at: https://aofund.org/privacy-policy/
MISCELLANEOUS CONDITIONS: (i) Only Entries that are actually received by Sponsor will be eligible for the prize. Sponsor is not responsible for lost, late, incomplete or misdirected Entries. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to Sweepstakes Entries or Entry forms; or alteration of Entries or Entry forms. Sponsor reserves the right to correct clerical or typographical errors in promotional materials or any materials related to the Sweepstakes. Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes without further obligation. Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website or violates these Official Rules. Sponsor has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void entries for any reason, including, but not limited to: multiple entries from the same user from different IP addresses, multiple entries from the same computer in excess of that allowed by Sweepstakes rules, or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws. Should such attempt be made, Sponsor reserves the right to seek damages to the fullest extent permitted by law.
(ii) By submitting an Entry, participants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, participants’ rights and obligations, or the rights and obligations of Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the applicable federal laws and the laws of the State of California, without giving effect to any choice of law or conflict of law rules. By submitting an Entry, participants consent to the jurisdiction and venue of the federal, state and local courts located in Santa Clara County, California.
WINNER LIST: To obtain the name of the winner(s) or the recording of the drawing for the winner(s), send a request to customercare@aofund.org. Only requests which specify the Entry Period of this Sweepstakes and which are received no later than 60 days after the end of the Entry Period will be honored.

Accion Opportunity Fund (el “Patrocinador”) lleva a cabo este sorteo de tarjetas de regalo (“Sorteo”) para las personas elegibles que contesten una encuesta (la “Encuesta”). Estas Reglas Oficiales (“Reglas”) rigen este Sorteo. Puede que haya detalles y requisitos para participar en esta promoción. Este Sorteo es nulo donde lo prohíba la ley.
PERÍODO DE PARTICIPACIÓN: El Período de participación en el Sorteo comienza a las 7:00 a. m., hora del Pacífico (PT), el 24 de marco de 2023 y finaliza a las 11:59 p. m., PT, el 10 de mayo de 2023.
CÓMO PARTICIPAR: Los (las) participantes pueden hacerlo ya sea por el Método de la Encuesta o por el Método de Participación sin Encuesta, como se describe en este documento:
(a) Método de la Encuesta: los (las) participantes elegibles pueden participar en el Sorteo visitando el enlace en aofund.org o el enlace del sitio web proporcionado en la invitación de la Encuesta enviada por correo electrónico, y contestando la Encuesta durante el Período de Participación. Los (las) participantes deben suministrar toda la información requerida, incluyendo su nombre, su apellido, y su dirección de correo electrónico. (b) Método de participación sin encuesta: para participar a través del método sin encuesta, no es necesario que se conteste una encuesta. Los (las) participantes elegibles deben enviar una participación visitando el enlace en aofund.org o el enlace del sitio web proporcionado en la invitación de la Encuesta enviada por correo electrónico, y suministrar su nombre, apellido, y su dirección de correo electrónico. Una participación se “recibe” cuando un (una) participante elegible suministra esta información y los servidores que usa el administrador del Sorteo registran la información (cada una = una “Participación”). Solo se permite una participación por cada invitación a la encuesta enviada por correo electrónico. La participación en el Sorteo no tiene ningún costo. Las participaciones se deben hacer en línea antes del 10 de mayo de 2023, a las 11:59 p.m. PST para poder participar. Sólo se puede participar una vez.
El ganador debe cumplir con los requisitos de elegibilidad establecidos en estas Reglas para calificar para el premio. En caso de discrepancia sobre la identidad de un (una) participante del Sorteo, cada Participación se considerará presentada por el (la) titular registrado (a) de la cuenta asociada a la dirección de correo electrónico. Si el Patrocinador no puede verificar a su satisfacción la identidad de la persona que realmente envió la Participación seleccionada como ganadora del Sorteo, la Participación afectada se considerará no elegible y el Patrocinador seleccionará al azar otra Participación como ganadora del Sorteo.
ELEGIBILIDAD: El Sorteo está abierto a personas que: (a) tengan 18 años o más en el momento de la Participación, y (b) hayan recibido un mensaje de correo electrónico del Patrocinador con un enlace al sitio web solicitando que contesten la Encuesta, O que hayan visitado el enlace a la Encuesta que figura en el sitio web del Patrocinador. Los empleados, funcionarios y directores del Patrocinador, sus empresas matrices, subsidiarias, afiliadas, representantes y agencias, y los miembros de sus familias directas (cónyuges, padres, hermanos e hijos, independientemente de dónde vivan) y quienes vivan en el mismo hogar no son elegibles para participar o ganar el Sorteo.
PREMIO: Una tarjeta de regalo de Amazon con un valor de $ 100, enviada por medios electrónicos. El valor aproximado al detal (“ARV”, por sus siglas en inglés) de cada premio es de $ 100. No se otorgará ninguna diferencia entre el valor al detal real de un premio y el ARV. El valor al detal real puede variar dependiendo de diversas variables. No se permite la sustitución, cesión o transferencia de ningún premio, excepto por parte del Patrocinador, que se reserva el derecho de sustituir los premios por otros de valor comparable o superior.
PROBABILIDADES DE GANAR: Las probabilidades de ganar dependen del número de Participaciones elegibles recibidas dentro del Período de Participación de este Sorteo.
SORTEO: Se realizará un sorteo al azar entre todas las Participaciones elegibles recibidas durante el Período de Participación para el Sorteo. El sorteo será realizado por el administrador de la Encuesta dentro de los 15 días calendario posteriores a la finalización del Período de Participación. A cada participación se le asignará un número aleatorio. Al final del periodo de participación se utilizará un generador de números aleatorios para seleccionar al ganador. Se grabará el proceso.
NOTIFICACIÓN a los GANADORES: Los ganadores serán notificados por teléfono y/o correo electrónico y están sujetos a la verificación de elegibilidad.
RESTRICCIONES DEL PREMIO: El premio no es transferible. Si el ganador no reclama el premio dentro de los cinco días posteriores a la notificación, no cumple con estas Reglas o no es elegible, y el Patrocinador podrá seleccionar un ganador alternativo entre todas las Participaciones elegibles restantes. El Patrocinador se reserva el derecho de reemplazar el premio por un otro de igual o mayor valor sin previo aviso. Todas las decisiones sobre asuntos relacionados con el Sorteo son definitivas. Todos los impuestos, tasas y recargos federales, estatales y locales sobre los premios son responsabilidad exclusiva del ganador del premio. El Patrocinador no reemplazará ningún premio de tarjeta de regalo que se pierda o sea robado una vez entregado al ganador.

Al participar en este Sorteo, cada participante otorga su permiso expreso para ser contactado (a) por el Patrocinador por teléfono, correo electrónico y/o correo postal a los fines del Sorteo.
El (La) ganador (a), mediante la aceptación del Premio, otorga al Patrocinador, y a cada uno de sus respectivos designados, el derecho de publicar el nombre, la dirección (ciudad y estado de residencia), la fotografía, la voz, las declaraciones y/u otra imagen del ganador y la información del premio con fines publicitarios, promocionales, comerciales y/o cualquier otro propósito en cualquier medio o formato ahora conocido o ideado en el futuro, en todo el mundo, a perpetuidad, sin limitación y sin compensación adicional, contrapartida, permiso o notificación, a menos que lo prohíba la ley.
POLÍTICA DE PRIVACIDAD: La información recopilada en relación con este Sorteo se utilizará de acuerdo con la Política de Privacidad del Patrocinador y estas Reglas. En el caso de cualquier discrepancia entre la Política de Privacidad del Patrocinador y estas Reglas, privará y regirá la Política de Privacidad del Patrocinador.
CONDICIONES VARIAS: (i) Solo las participaciones que realmente reciba el Patrocinador serán elegibles para el premio. El Patrocinador se reserva el derecho, a su entera discreción, de cancelar, rescindir, modificar o suspender el Sorteo sin más obligaciones. El Patrocinador se reserva el derecho, a su entera discreción, de descalificar a cualquier persona que manipule o intente manipular el proceso de participación, o el funcionamiento del Sorteo o sitio web, o viole estas Reglas Oficiales. El Patrocinador tiene el derecho, a su entera discreción, de mantener la integridad del Sorteo, de anular las participaciones por cualquier motivo, incluyendo, pero sin limitarse a: múltiples participaciones de un mismo usuario de diferentes direcciones IP, múltiples participaciones del mismo computador en exceso de lo permitido por las reglas del Sorteo, o el uso de bots, macros, scripts u otros medios técnicos para participar. Cualquier intento de un (una) participante de dañar deliberadamente cualquier sitio web o de adulterar el funcionamiento legítimo del Sorteo podría ser una infracción de las leyes civiles y penales. Si tal intento se materializa, el patrocinante se reserva el derecho de buscar resarcirse de los daños al máximo permitido por la ley.
(ii) Al enviar una Participación, los (las) participantes acuerdan que todas las cuestiones y preguntas relacionadas con la construcción, validez, interpretación y aplicabilidad de estas Reglas, los derechos y obligaciones de los (las) participantes, o los derechos y obligaciones del Patrocinador en relación con el Sorteo, se regirán e interpretarán de acuerdo con las leyes federales aplicables y las leyes del Estado de California, sin dar efecto a ninguna elección del derecho aplicable o conflicto de leyes. Al enviar una Participación, los (las) participantes aceptan a la jurisdicción y el territorio de los tribunales federales, estatales y locales ubicados en el Condado de Santa Clara, California.
