A PURCHASE, CONTRIBUTION, OR PAYMENT WILL NOT IMPROVE YOUR CHANCES OF WINNING. BY ENTERING THE SWEEPSTAKES, ENTRANT AGREES TO BE BOUND BY THESE OFFICIAL RULES. 

Accion Opportunity Fund Community Development (the “Sponsor”) is conducting this gift card sweepstakes (“Sweepstakes”) for eligible individuals who complete a survey (the “Survey”). These Official Rules below and the Basic Terms for Gift Card Sweepstakes detailed on the first page of the survey (“Rules”) govern this Sweepstakes. The Basic Terms for Gift Card Sweepstakes detailed on the first page of the survey are incorporated herein by reference. Please carefully review the Basic Terms for Gift Card Sweepstakes detailed on the first page of the survey for important eligibility and other information. Details and qualifications for participation in this promotion may apply. This Sweepstakes is void where prohibited by law.

ENTRY PERIOD: The Entry Period of the Sweepstakes is specified in the Basic Terms for Gift Card Sweepstakes detailed on the first page of the survey.

ELIGIBILITY: The eligibility criteria are specified in the Basic Terms for Gift Card Sweepstakes detailed on the first page of the survey. Employees, officers and directors of the Sponsor, its parents, subsidiaries, affiliates, representatives and agencies, and members of their immediate families (spouses, parents, siblings and children, regardless of where they live) and those living in the same household are not eligible to enter or win the Sweepstakes.

HOW TO ENTER: Participants may enter either by the Survey Method or by the No-Survey Entry Method, as described herein:
(a) Survey Method: Eligible participants can enter the Sweepstakes by visiting the link on aofund.org or the website link provided in the Survey invitation sent via email and completing the Survey during the Entry Period. Entrants must complete all required information, including information specified in the Basic Terms for Gift Card Sweepstakes detailed on the first page of the survey. An entry is “received” when an eligible participant completes the Survey and the servers for the Survey administrator record the information (each, an “Entry”). Only one Entry is permitted for each Survey invitation sent via email. There is no cost to enter the Sweepstakes.. You may enter only once. The length of time required to complete a survey will vary as specified in the Basic Terms for Gift Card Sweepstakes detailed on the first page of the survey.

(b) No-Survey Entry Method: To enter via the No-Survey Method, you are not required to complete a survey to enter. Eligible entrants must submit an entry by visiting the link on aofund.org or the website link provided in the Survey invitation sent via email and providing your first name, last name, date of birth, and email address. An entry is “received” when an eligible participant provides this information and the servers for the Sweepstakes administrator record the information (each, an “Entry”). Only one Entry is permitted for each Survey invitation sent via email. There is no cost to enter the Sweepstakes. Entries must be made online by by the time specified in the Basic Terms for Gift Card Sweepstakes detailed on the first page of the survey. You may enter only once.

The winner must meet the eligibility requirements set forth in these Rules in order to qualify for the prize. In the event of a dispute over the identity of a Sweepstakes entrant, each Entry will be deemed submitted by the registered account holder of the email address associated with the Entry. If the Sponsor is not able to verify to its satisfaction the identity of the individual who actually submitted the Entry selected as the Sweepstakes winner, the affected Entry will be deemed ineligible and the Sponsor will draw another Entry as Sweepstakes winner.

PRIZE: The value of the prize is specified in the Basic Terms for Gift Card Sweepstakes detailed on the first page of the survey. Any difference between the actual retail value of a prize and the ARV will not be awarded. The actual retail value may vary depending on variables. No substitution, assignment or transfer of any prizes are permitted, except by Sponsor, who reserves the right to substitute the prizes with another of comparable or greater value.

ODDS OF WINNING: Odds of winning depend upon the number of eligible Entries received within the Entry Period for this Sweepstakes.

PRIZE DRAWING: A random drawing will be conducted from among all eligible Entries received during the Entry Period for the Sweepstakes. The prize drawing will be conducted by the Survey administrator within the timeframe specified in the Basic Terms for Gift Card Sweepstakes detailed on the first page of the survey. Each entry will be assigned a random number. At the end of the entry period a random number generator will be used to select the winner. The process will be recorded.

WINNER(S) NOTIFICATION: The winner(s) will be notified via telephone and/or e-mail and is subject to verification of eligibility.

PRIZE RESTRICTIONS: The prize is not transferable. If the winner fails to claim the prize within five days of notification, fails to abide by these Rules, or is otherwise ineligible, Sponsor may select an alternate winner from all remaining eligible Entries. Sponsor reserves the right to substitute a prize of equal or greater value without notice. All decisions on matters pertaining to the Sweepstakes are final. All federal, state and local taxes, fees and surcharges on prizes are the sole responsibility of the prize winner. Sponsor will not replace any gift card prize that is lost or stolen once delivered to the winner.

WAIVER OF LIABILITY/PUBLICITY RELEASE: By participating in the Sweepstakes and submitting an Entry, each participant agrees to (i) be bound by these Rules, including all entry requirements, and (ii) waive any and all claims against the Sponsor and Survey administrator and their respective parents, affiliated companies, subsidiaries, officers, directors, employees, agents, licensees, representatives and advertising and promotion agencies, and any and all other companies associated with the Sweepstakes, and all of their respective officers, directors, employees, agents and representatives (collectively, the “Released Parties”) for any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from the participation in the Sweepstakes or from the receipt or use of any prize (or any portion thereof) or any travel or activity related to the receipt or use of any prize (or any portion thereof). By entering this Sweepstakes, each participant gives his/her express permission to be contacted by the Sponsor by telephone, e-mail and/or postal mail for Sweepstakes purposes.

The winner, by acceptance of Prize, grants to Sponsor, and each of its respective designees, the right to publicize the winner’s name, address (city and state of residence), photograph, voice, statements and/or other likeness and prize information for advertising, promotional, trade and/or any other purpose in any media or format now known or hereafter devised, throughout the world, in perpetuity, without limitation and without further compensation, consideration, permission or notification, unless prohibited by law.

PRIVACY POLICY: Information collected in connection with this Sweepstakes will be used in accordance with Sponsor’s Privacy Policy and these Rules. In the event of any discrepancy between Sponsor’s Privacy Policy and these Rules, Sponsor’s Privacy Policy shall control and govern. Sponsor’s Privacy Policy is available at: https://aofund.org/privacy-policy/

MISCELLANEOUS CONDITIONS: (i) Only Entries that are actually received by Sponsor will be eligible for the prize. Sponsor is not responsible for lost, late, incomplete or misdirected Entries. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to Sweepstakes Entries or Entry forms; or alteration of Entries or Entry forms. Sponsor reserves the right to correct clerical or typographical errors in promotional materials or any materials related to the Sweepstakes. Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes without further obligation. Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website or violates these Official Rules. Sponsor has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void entries for any reason, including, but not limited to: multiple entries from the same user from different IP addresses, multiple entries from the same computer in excess of that allowed by Sweepstakes rules, or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws. Should such attempt be made, Sponsor reserves the right to seek damages to the fullest extent permitted by law.
(ii) By submitting an Entry, participants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, participants’ rights and obligations, or the rights and obligations of Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the applicable federal laws and the laws of the State of California, without giving effect to any choice of law or conflict of law rules. By submitting an Entry, participants consent to the jurisdiction and venue of the federal, state and local courts located in Santa Clara County, California.

WINNER LIST: To obtain the name of the winner(s) or the recording of the drawing for the winner(s), send a request to customercare@aofund.org. Only requests which specify the Entry Period of this Sweepstakes and which are received no later than 60 days after the end of the Entry Period will be honored.

Accion Opportunity Fund Community Development (el “Patrocinador”) está llevando a cabo este sorteo de tarjetas de regalo (el “Sorteo”) para personas elegibles que completen una encuesta (la “Encuesta”). ELEGIBILIDAD: Los criterios de elegibilidad se especifican en los Términos Básicos para el Sorteo de Tarjetas de Regalo en la primera página de la encuesta. Los empleados, funcionarios y directores del Patrocinador, sus empresas matrices, subsidiarias, afiliadas, representantes y agencias, y los miembros de sus familias inmediatas (cónyuges, padres, hermanos e hijos, independientemente de dónde vivan) y quienes vivan en el mismo hogar no son elegibles para participar o ganar el Sorteo. 

CÓMO PARTICIPAR: Los participantes pueden participar ya sea por el Método de Encuesta o el Método de Participación sin Encuesta, como se describe a continuación:(a) Método de Encuesta: Los participantes elegibles pueden participar en el Sorteo visitando el enlace en aofund.org o el enlace proporcionado en la invitación de la Encuesta enviada por correo electrónico y completando la Encuesta durante el Periodo de Participación. La duración necesaria para completar una encuesta variará según lo especificado en los Términos Básicos para el Sorteo de Tarjetas de Regalo detallados en la primera página de la encuesta.

(b) Método de Participación sin Encuesta: Para participar sin completar una encuesta, los participantes elegibles deben enviar una participación visitando el enlace en aofund.org o el enlace proporcionado en la invitación de la Encuesta enviada por correo electrónico e ingresando su nombre, apellido, fecha de nacimiento y correo electrónico. Se considera que una participación ha sido “recibida” cuando un participante elegible proporciona esta información y los servidores del administrador del Sorteo registran la información (cada una, una “Participación”). Solo se permite una Participación por cada invitación de Encuesta enviada por correo electrónico. No hay ningún costo para participar en el Sorteo. Las participaciones deben realizarse en línea antes del tiempo especificado en los Términos Básicos para el Sorteo de Tarjetas de Regalo detallados en la primera página de la encuesta. Solo puedes participar una vez. 

El ganador debe cumplir con los requisitos de elegibilidad establecidos en estas Reglas para calificar para el premio. En caso de disputa sobre la identidad de un participante del Sorteo, cada Participación se considerará enviada por el titular registrado de la cuenta de correo electrónico asociada con la Participación. Si el Patrocinador no puede verificar satisfactoriamente la identidad de la persona que envió la Participación seleccionada como ganadora del Sorteo, la Participación afectada se considerará no elegible y el Patrocinador seleccionará otra Participación como ganadora del Sorteo. 
PREMIO: El valor del premio se especifica en los Términos Básicos para el Sorteo de Tarjetas de Regalo detallados en la primera página de la encuesta. Cualquier diferencia entre el valor al detal real de un premio y el ARV no será otorgada. El valor al detal real puede variar dependiendo de diversas variables. No se permite la sustitución, cesión o transferencia de ningún premio, excepto por parte del Patrocinador, quien se reserva el derecho de sustituir los premios por otros de valor comparable o superior. 

PROBABILIDADES DE GANAR: Las probabilidades de ganar dependen del número de Participaciones elegibles recibidas dentro del Período de Participación de este Sorteo. 
SORTEO: Se realizará un sorteo al azar entre todas las Participaciones elegibles recibidas durante el Período de Participación del Sorteo. El sorteo será realizado por el administrador de la Encuesta dentro del período especificado en los Términos Básicos para el Sorteo de Tarjetas de Regalo detallados en la primera página de la encuesta. A cada participación se le asignará un número aleatorio. Al final del Período de Participación, se utilizará un generador de números aleatorios para seleccionar al ganador. El proceso será grabado. 

NOTIFICACIÓN A LOS GANADORES: Los ganadores serán notificados por teléfono y/o correo electrónico y estarán sujetos a verificación de elegibilidad. 
RESTRICCIONES DEL PREMIO: El premio no es transferible. Si el ganador no reclama el premio dentro de los cinco días posteriores a la notificación, no cumple con estas Reglas o no es elegible, el Patrocinador podrá seleccionar un ganador alternativo entre todas las Participaciones elegibles restantes. El Patrocinador se reserva el derecho de sustituir el premio por otro de igual o mayor valor sin previo aviso. Todas las decisiones sobre asuntos relacionados con el Sorteo son finales. Todos los impuestos federales, estatales y locales, tarifas y recargos sobre el premio son responsabilidad exclusiva del ganador. Al ingresar a este Sorteo, cada participante otorga su permiso expreso para ser contactado por el Patrocinador por teléfono, correo electrónico y/o correo postal con fines relacionados con el Sorteo. 
El ganador, al aceptar el Premio, otorga al Patrocinador y a cada uno de sus designados, el derecho de publicitar el nombre, dirección (ciudad y estado de residencia), fotografía, voz, declaraciones y/u otra imagen y la información del premio del ganador con fines publicitarios, promocionales, comerciales y/o cualquier otro propósito en cualquier medio o formato, conocido ahora o ideado en el futuro, en todo el mundo, a perpetuidad, sin limitación y sin compensación, consideración, permiso o notificación adicional, salvo que la ley lo prohíba. 
POLÍTICA DE PRIVACIDAD: La información recopilada en relación con este Sorteo se utilizará de acuerdo con la Política de Privacidad del Patrocinador y estas Reglas. En caso de cualquier discrepancia entre la Política de Privacidad del Patrocinador y estas Reglas, la Política de Privacidad del Patrocinador prevalecerá y regirá.
